These Terms & Conditions (“Terms”) govern your access to and use of www.lmmatelier.com (the “Site”) and any products or services offered by LMM Atelier (“LMM Atelier,” “we,” “our,” or “us”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

1. Eligibility

You must be at least 18 years of age or have the consent of a parent or legal guardian to use this Site or make a purchase.

2. Products

LMM Atelier offers original, handmade, curated, vintage, thrifted, repurposed, reworked, and limited-edition products.

Because many of our items are one-of-a-kind or handcrafted:

  • Availability is limited.
  • Products may not be reproduced or restocked.
  • Variations in color, texture, pattern, finish, materials, stitching, wood grain, fabric wear, and other characteristics are normal and are not considered defects.
  • Vintage, thrifted, curated, and repurposed items may show signs of age or previous use consistent with their nature. Any material defects known at the time of listing will be disclosed whenever reasonably possible.

Product photographs are intended to represent each item accurately. Actual colors may vary due to monitor settings, lighting, and device displays.

3. Pricing & Availability

All prices are listed in U.S. Dollars (USD).

Prices, product availability, promotions, and specifications may change without notice.

We reserve the right to correct pricing errors, product descriptions, inventory inaccuracies, or typographical mistakes at any time, including after an order has been placed. If an order is canceled due to an error, any payment received will be refunded.

4. Orders

We reserve the right to:

  • Refuse or cancel any order.
  • Limit quantities purchased.
  • Request additional verification before accepting an order.
  • Cancel orders suspected of fraud, unauthorized activity, pricing errors, or violations of these Terms.

Ownership of products transfers upon delivery to the shipping carrier.

5. Payments

Payment is due in full at the time of purchase.

By placing an order, you represent that you are authorized to use the selected payment method.

Failure to complete payment may result in order cancellation or restrictions on future purchases.

6. Shipping, Returns & Final Sale

Shipping, delivery, returns, exchanges, cancellations, and final sale policies are governed by our Shipping & Final Sale Policy, which is incorporated into these Terms by reference.

7. Live Sales

Purchases made through live selling platforms, including Shopify, Whatnot, TikTok Shop, Instagram, Facebook, or other approved platforms, are subject to these Terms and our Shipping & Final Sale Policy.

Participation in any live sale constitutes acceptance of all applicable policies.

All content on this Site, including but not limited to:

  • Branding
  • Product names
  • Product descriptions
  • Artwork
  • Original designs
  • Graphics
  • Photographs
  • Videos
  • Text

  • Layout

is owned by or licensed to LMM Atelier and is protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, published, sold, scraped, or used for commercial purposes without our prior written permission.

9. Acceptable Use

You agree not to:

  • Violate any applicable law or regulation.
  • Use the Site for fraudulent or unlawful purposes.
  • Interfere with the operation or security of the Site.
  • Attempt unauthorized access to our systems.
  • Upload malicious code or harmful software.

10. User Content

We reserve the right to remove content at our sole discretion.

Our total liability for any claim shall not exceed the purchase price paid for the specific product giving rise to the claim.

LMM Atelier shall not be responsible for delays or failure to perform resulting from events beyond our reasonable control, including natural disasters, severe weather, fire, acts of government, labor disputes, supply chain disruptions, transportation delays, internet outages, cyberattacks, utility failures, or other unforeseen events.

15. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Florida, without regard to conflict of law principles.

Failure by LMM Atelier to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

These Terms, together with our Privacy Policy and Shipping & Final Sale Policy, constitute the entire agreement between you and LMM Atelier regarding your use of the Site and your purchases.

19. Changes to These Terms

We may modify these Terms at any time by posting an updated version on this Site. Continued use of the Site following any changes constitutes acceptance of the revised Terms.
